RED NUEVOS SERVICIOS FINANCIEROS – MiRed

These Policies (hereinafter, the “Policies”) govern the use of the services of the website www.mired.com.do (hereinafter, the “Website”) of Red Nuevos Servicios Financieros, S. A. – MiRed (hereinafter, “MiRed”).

Conditions

Minors.- To use Services that require MiRed to collect Personal Data through the Website, minors must obtain prior permission from their parents, guardians, or legal representatives, who will be considered responsible for all acts performed by the minors in their care.

1. Obligation to make proper use of the Website and the Services.- The User undertakes to use the Website and the Services in accordance with the law, these Policies, the Terms of Use, the Specific Conditions of certain Services, and any other notices and instructions brought to their attention, as well as public order, morality, and generally accepted good practices.
2. The User must refrain from obtaining, or even attempting to obtain, the Content by means or procedures other than those that, as the case may be, have been made available to them for this purpose or indicated on the web pages where the content is located or, in general, those commonly used on the Internet, provided they do not pose a risk of damage to or disabling of the Website, the Services, and/or the content.

All trademarks, trade names, or distinctive signs of any kind that appear on the Website are the property of MiRed or third parties, and use of or access to the Website and/or the Services shall not be understood to grant the User any right over said distinctive signs.

Likewise, the Content is the intellectual property of MiRed or third parties, and none of the exploitation rights that exist or may exist over said content shall be understood to be assigned to the User by virtue of these Policies beyond what is strictly necessary for the proper use of the Website and the Services. That is, the User may view, copy, and store on their computer's hard drive or on any other physical medium, print, or reproduce the material available on this website exclusively for their personal or private use, or for use within their company or organization, always acknowledging MiRed's ownership of it.    MIRED DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY RESULT FROM THE LACK OF AVAILABILITY OR CONTINUITY OF THE OPERATION OF THE WEBSITE AND THE SERVICES, FROM THE FAILURE TO MEET THE USEFULNESS THAT THE USER MAY HAVE ATTRIBUTED TO THE WEBSITE AND/OR THE SERVICES, FROM THE FALLIBILITY OF THE WEBSITE AND/OR THE SERVICES, AND IN PARTICULAR, THOUGH NOT EXCLUSIVELY, FROM FAILURES IN ACCESSING THE DIFFERENT WEB PAGES OF THE WEBSITE OR THOSE FROM WHICH THE SERVICES ARE PROVIDED.

Privacy and security in the use of the Website and the Services.- MiRed does not guarantee the privacy and security of the use of the Website and the Services and, in particular, does not guarantee that unauthorized third parties will not be able to learn the type, conditions, characteristics, and circumstances of the User's use of the Website and the Services.
3. Quality.- MiRed does not control or guarantee the absence of viruses or other elements in the Content that may cause alterations to your computer system (software and hardware) or to the electronic documents and files stored on your computer system.
4. Truthfulness, accuracy, and timeliness.- MIRED DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE LACK OF TRUTHFULNESS, ACCURACY, AND/OR TIMELINESS OF THE CONTENT.
5. Lawfulness, reliability, and usefulness.- MiRed does not guarantee the lawfulness, reliability, and usefulness of the services provided by third parties through the Website. MIRED DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE WEBSITE.
   
   

Procedure in the event of unlawful activities

If any User or third party considers that there are facts or circumstances revealing the unlawful nature of the use of any content and/or the performance of any activity on the web pages included in or accessible through the Website, and in particular, the infringement of intellectual property rights or other rights, they must send a notification to MiRed stating the following:

1. Personal data of the claimant: name, ID card (cédula) number (or passport, for foreign nationals), address, telephone number, and email address;
2. Specification of the alleged unlawful activity carried out on the Website and, in particular, in the case of an alleged infringement of rights, a precise and specific indication of the protected content as well as its location on the web pages;
3. Facts or circumstances revealing the unlawful nature of said activity;
4. In the case of an infringement of rights, a handwritten or equivalent signature, with the Personal Data of the holder of the allegedly infringed rights or of the person authorized to act on their behalf;
5. An express, clear statement, under the claimant's responsibility, that the information provided in the notification is accurate and that the use of the content or the performance of the described activities is unlawful.
   
   

Notifications

All notifications and communications (hereinafter, the “Notifications”) from the User to MiRed shall be considered effective, for all purposes, when sent to us by courier.

Applicable Law

These Policies are governed in each and every one of their parts by the laws of the Dominican Republic.

Jurisdiction
